Nicci Sims Art is based in South Africa. These terms describe enquiries, commissioned portraits and original artwork purchases. Please contact [email protected] with questions before agreeing an order.

Enquiries and agreement

This website is a portfolio and enquiry service, not an online checkout. An enquiry does not reserve artwork or commit you to buy. Availability, the brief, price, currency, delivery charges and order terms will be confirmed in writing before you accept an order. Keep a copy of that agreement.

Commissioned portraits

The size, subjects, reference photographs, estimated timing and included revisions will be agreed before work starts. A 50% deposit is normally required to book a commission, with the balance due before dispatch. Any different arrangement will be set out in your quote. Changes to an agreed brief may change the cost or timing and require your approval.

Reference photographs and permissions

To commission an artwork, please provide a suitable, clear original photograph that you have taken yourself or have permission to use as a reference. AI-generated reference images are not accepted.

If a photograph was taken by someone else, including a professional photographer, written permission from the photographer or relevant rights holder must be provided before it can be accepted. The permission must expressly allow the photograph to be used as a reference for a commissioned artwork.

Obtain permission to share images of other people, including a parent or guardian's permission where appropriate. I will let you know if a reference is unsuitable before starting.

Photographs of another artist's work are accepted only with written permission from that artist or the relevant rights holder expressly authorising its use for the commission. Where the photograph was also taken by someone else, permission to use the photograph is required as well. Commissions that copy or reproduce famous artworks are not accepted.

Please provide any required written permissions before work begins. I may decline a reference image if the necessary permissions cannot be confirmed.

Original artwork and payment

Original pieces are subject to availability. A written quote will confirm the piece, condition, dimensions, framing where applicable and total payable. Payment instructions are supplied directly; this website does not collect card details. Screen colours and photographed details can differ slightly from the physical artwork.

Timing, delivery and damage

Completion and delivery estimates are discussed before booking. Please mention a particular deadline when enquiring. Artwork is packaged for delivery, with courier options and charges agreed before purchase. Any applicable international import charges will be explained as part of the delivery arrangements. If artwork is delayed, damaged or missing, contact me so the issue can be investigated and an appropriate remedy arranged.

Cancellations, returns and concerns

Please contact me promptly if you need to cancel or change an order. Any cancellation costs must reflect the circumstances, work completed and applicable law; a deposit is not automatically forfeited in every case. The agreed order terms will explain cancellation and return arrangements. A personalised commission may be treated differently from an existing original. These terms do not exclude rights or remedies for defective goods or any other mandatory consumer protection.

Copyright and sharing

Copyright and permitted use of a commission will be agreed in writing in accordance with applicable law. Ownership of a physical drawing and copyright are separate matters. Commercial reproduction or other uses requiring permission must be agreed with the rights holder. Permission to display a commission or identifiable reference photographs publicly will be discussed with you; please mention any privacy or gift restrictions.

Resolving issues

Please email the details of any concern so I can work with you towards a resolution. South African law applies subject to any mandatory protections applicable to your order. Nothing here removes your right to use an appropriate regulator, dispute process or court.

Privacy and changes

Personal information is handled as described in the Privacy Policy. Future changes to this page do not replace the terms already agreed for an existing order.
